1. Agreement to Terms

By accessing or using the services provided by Arttention Media ("we," "our," or "us"), including our website at arttentionmedia.pro and any related services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Services

Arttention Media provides AI-powered marketing services including but not limited to:

• AI agent and chatbot development
• Website design, development, and deployment
• Marketing automation and lead generation
• AI content creation and creative services
• Sales pipeline automation

Specific deliverables, timelines, and pricing are defined in individual project agreements or proposals.

3. Payment Terms

Payment terms are outlined in your project proposal or agreement. Unless otherwise specified:

• A 50% deposit is required before work begins
• Remaining balance is due upon project completion
• We accept bank transfers, M-Pesa, and major credit cards
• Late payments may incur a 5% monthly fee after 30 days overdue
• All prices are quoted in the currency specified in your proposal (KES, USD, CAD, GBP, AUD, EUR)

4. Intellectual Property

Upon full payment, you own all custom work created specifically for your project, including website code, custom designs, and content. We retain the right to:

• Showcase the work in our portfolio
• Use reusable components and frameworks in future projects
• Retain ownership of proprietary tools, templates, and AI systems used in delivery

Third-party assets (fonts, stock images, AI-generated images) are subject to their respective licenses.

5. AI-Generated Content

Our services utilize artificial intelligence to generate content, images, code, and other materials. While we strive for accuracy and quality, AI-generated content may occasionally contain errors or inaccuracies. You are responsible for reviewing and approving all deliverables before they go live.

6. Client Responsibilities

You agree to:

• Provide timely feedback and approvals to keep projects on schedule
• Supply accurate business information, content, and assets as needed
• Ensure you have the right to use any materials you provide to us
• Maintain the security of any accounts or access credentials we create for you

7. Revisions & Changes

Each project includes a defined number of revision rounds as specified in your proposal. Additional revisions beyond the included rounds will be billed at our standard hourly rate. Major scope changes may require a new proposal.

8. Limitation of Liability

To the maximum extent permitted by law, Arttention Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to loss of revenue, data, or business opportunities.

9. Termination

Either party may terminate a project with 14 days written notice. Upon termination, you are responsible for payment of all work completed up to the termination date. We will deliver all completed work and provide reasonable transition support.

10. Governing Law

These terms are governed by the laws of Kenya. For clients in Canada, disputes may be resolved under the laws of Ontario, Canada. Any disputes shall be resolved through good-faith negotiation before pursuing legal remedies.
